These Terms of Service ("Terms") govern your use of the Henori web platform and mobile application (together, the "Service"). By creating an account or using the Service you agree to these Terms and to our Privacy Policy.
• If you use the Service on behalf of a kindergarten or other organisation, you confirm that you are authorised to accept these Terms for it.
• If you do not agree with these Terms, you must not use the Service.
2 The Service
Henori is a management platform for kindergartens. It lets kindergartens manage children, groups, staff, attendance, daily reports, documents, contracts and invoices, and lets parents follow their child's day.
• Kindergartens ("Clients") subscribe to the Service and invite their staff and the parents of enrolled children.
• Parents and staff receive access only to the data of the kindergarten that invited them.
• We may add, change or remove features of the Service at any time.
3 Accounts
You are responsible for keeping your login credentials confidential and for all activity under your account.
• Provide accurate information and keep it up to date.
• Notify the kindergarten or Henori immediately if you suspect unauthorised use of your account.
• Accounts are personal and may not be shared or transferred.
4 Responsibilities of Kindergartens
A Client that uses the Service to process data about children, parents and staff acts as the data controller for that data.
• Obtain the consents and provide the notices required by law before entering personal data about children, parents and staff.
• Only grant access to people who are entitled to see the data, and remove access when it is no longer needed.
• Ensure that photos, documents and messages shared through the Service are lawful and appropriate.
5 Children and Parents
The Service is intended for use by adults. Children do not use the Service directly; information about them is entered by their kindergarten and their parents or guardians.
• Parents may update their child's medical information and documents and are responsible for its accuracy.
• Photos of a child are shared only with the kindergarten and the child's own parents, subject to the sharing preferences set for that child.
6 Acceptable Use
You agree not to misuse the Service. In particular you must not:
• Upload content that is unlawful, abusive, or infringes the rights of others.
• Attempt to access data or accounts you are not authorised to access.
• Interfere with the operation or security of the Service, or use it to send spam.
• Copy, resell or reverse engineer the Service.
7 Subscriptions and Payments
Access to the Service by a Client is subject to the subscription agreed with Henori.
• Subscription fees, billing periods and payment terms are set out in the Client's agreement or invoice.
• Invoices issued by a kindergarten to parents through the Service are between the kindergarten and the parent. Henori is not a party to them.
• We may suspend a Client's access if fees remain unpaid after reasonable notice.
8 Intellectual Property
The Service, including its software, design and trademarks, belongs to Henori and its licensors.
• You keep ownership of the content you upload. You grant Henori a licence to store, process and display it only as needed to provide the Service.
• You may not use the Henori name or logo without our written permission.
9 Availability and Support
We aim to keep the Service available at all times but cannot guarantee uninterrupted access.
• We may perform maintenance, which can cause short interruptions. We try to announce planned maintenance in advance.
• Push notifications and real-time features depend on third-party services and your device settings and may be delayed.
10 Termination
You may stop using the Service at any time. A Client may end its subscription in line with its agreement.
• We may suspend or terminate access that violates these Terms or puts the Service or its users at risk.
• After termination we delete or return Client data in line with our Privacy Policy and applicable law.
11 Limitation of Liability
The Service is provided "as is". To the extent permitted by law, Henori is not liable for indirect or consequential losses, loss of data caused by factors outside our control, or decisions taken by a kindergarten or parent based on information in the Service.
• Nothing in these Terms limits liability that cannot be limited by law.
• Our total liability to a Client is limited to the fees paid by that Client in the twelve months before the claim.
12 Changes to These Terms
We may update these Terms from time to time. The "Last Updated" date at the top shows when they last changed.
• For material changes we will notify Clients through the Service or by email.
• Continued use of the Service after a change means you accept the updated Terms.
13 Governing Law
These Terms are governed by the laws of the Republic of Kosovo. Any dispute that cannot be resolved amicably is subject to the courts of Kosovo, unless mandatory consumer law gives you the right to another forum.
